Home « Privacy Policy

The last stage in the life of a construction site is demolition. Demolition of the building is one of the types of construction work. This means that before demolition it is necessary to obtain administrative permits to perform this activity. What exactly is the demolition of the building according to the law on construction and what formalities should be performed before its implementation?

What is dismantling according to the construction law?
Under the current legislation, there is no unambiguous definition of demolition of the building. However, according to Art. 3 sec. 7 of the Law on Construction of July 7, 1994, demolition work is one of the types of construction work, which is associated with legal consequences. Based on this provision, it should be understood that all construction of facilities, as well as work aimed at their reconstruction, installation, repair and demolition, includes construction work. This means that the demolition of building structures requires the application of relevant administrative procedures and sanctions for their non -compliance.

In the understanding of demolition work under the law on construction, it is worth familiarizing yourself with the content of Art. 28 of this Law. It says that construction work can only be started on the basis of a decision on building permission. This may seem incomprehensible, because the demolition of the building is the reverse action, but legally it is one of the construction work.

Demolition and dismantling work without permission and with resolution
Some work on demolition and demolition do not require permission. These include the demolition of buildings and structures that are not included in the register of monuments and not under the protection of nature. The height of such objects cannot exceed 8 m if they are located no more than half of its height from the boundary of the site. In addition, resolution does not require the demolition of buildings and construction equipment, the construction of which does not require building permission, unless they are protected as historical monuments. However, it should be noted that in the first case, the demolition of the building requires notification of this act of the competent authority, as well as the form, volume and method of demolition work.

The administrative body may dispose of the receipt of permission to demolish objects if the performance of this task may affect the deterioration of the water regime, the state of the environment and the sanitary-hygienic state, and also requires maintaining the conditions on which the dismantling work depends. In addition, the competent authority has the right to request any data on the building or information about demolition, for the safety of people or property.

All work on demolition, demolition and protection can be performed before permission or before they are notified in a situation where their goal is to eliminate a direct threat to people or property. However, the beginning of these works does not exempt from the obligation to immediately obtain permission to carry out them. All other objects not indicated in Art. The Construction Law and those that require building permission must have a permit for demolition. Rhino Gold Gel United States blog http://rhino-gold-gel.com/EN/
